<p>Time Warner Cable and Viacom have finally come to an agreement and ended the dispute that has been ongoing for over a year. It started back in April last year when TWCable TV <a href="http://www.imore.com/2011/03/24/time-warner-cable-receiving-cease-desist-orders-ipad-app/">started to receive cease and desist</a> orders from various TV networks over its TWCable TV app. Viacom was the most vocal and it led to <a href="http://www.imore.com/2011/04/01/time-warner-cable-pulls-channels-twcable-tv-app-ipad/">TW Cable having to remove lots of channel</a>s from the app. Time Warner Cable <a href="http://www.imore.com/2011/04/07/time-warner-cable-viacom-officially-war-twcable-tv-app-ipad/">filed a request for declaratory judgement</a> and a year later appear to have resolved the dispute. We have heard very little since then but subscribers have still missed out on the channels that were removed.
<blockquote>Viacom and Time Warner Cable have agreed to resolve their pending litigations.  All of Viacom’s programming will now be available to Time Warner Cable subscribers for in-home viewing via internet protocol-enabled devices such as iPads and Time Warner Cable will continue to carry Viacom’s Country Music Television (CMT) programming.  In reaching the settlement agreement, Time Warner Cable and Viacom were also able to resolve other unrelated business matters to their mutual satisfaction.  Neither side is conceding its original legal position or will have further comment.</blockquote>
This will come as a welcome relief to all TW Cable subscribers as the removed programmes will start to appear on TWC TV over the next several weeks. Soon you will again be able to enjoy the much loved Jersey Shore or Comedy Central's The Daily Show. As an added bonus, TW Cable subscribers will also see some additional content from Viacom like MTV Hits, MTV Jams and Centric. If you live in the New York or other major markets, you will also get access to TV Land HD and Bet HD too.</p>

<p>Have you pre-ordered your <a href="http://imore.com/ipad">new iPad</a> yet? If not, you could be in for a bit of a wait. It seems that Apple have pushed back the shipping date in most counties. <p>People in the US, have a little while longer to go yet; however Apple are warning that the new iPad is in 'limited supplies', so they could be seeing a delay very soon.</p>

<p>Time Warner has just updated its TWC TV app and it is now fully compatible with the iPhone and iPod touch. Since its launch back in March 2011, it has been an iPad only app, but not any longer. If you are a Time Warner Cable subscriber, you can now watch live TV, manage your DVR and change channels on your set-top box on your iPhone and iPod touch.

    <li>Set-top box tuning – tap on a network logo or “watch on TV” button within the program description to tune compatible set-top boxes directly to the channel</li>

<div>Time Warner has a massive line up of available channels and is <a href="http://www.twcableuntangled.com/2012/01/twc-tv%E2%84%A2-app-now-available-for-iphone/">currently listing over 196</a>; although it does state not all of them may be available depending on your location. The TWC TV app is available form the App Store as a free download although you do need to be a Time Warner cable subscriber to view any live TV. The update also makes it a universal binary so one app works across iPhone, iPad and iPod touch.</div>

<p>Time Inc. has announced they plan to bring all of their 21 US magazine titles to iPad and other tablets by year's end.</p>

<p>A bunch of print newspapers and magazines seem to be finally jumping on board the iPad subscription train, including <em>The Telegraph</em> (UK), Heart properties including <em>Esquire, Popular Mechanics</em>, and <em>O, The Oprah Magazine</em>, and Time has somehow swung a deal to get existing <em>Time, Fortune</em>, and <em>Sports Illustrated</em> readers free access via iPad.</p>

<p>And, of course, <a href="http://www.imore.com/2011/05/06/playboy-magazine-coming-18th-complete-uncensored/"><em>Playboy</em> is coming uncensored</a> (my guess is web app, no iOS-handled subscriptions). </p>

<p>Meanwhile the launched-with-much-todo <em>The Daily</em> has reportedly gotten 800K downloads but is losing $10 million a month. </p>

<p>The big stumbling block was, is, and remains Apple's insistence that users opt-in to sharing their demographic data with publishers (while the publishers would prefer opt-out since they figure -- probably rightly -- few users will actively choose to share). Publishers have historically <a href="http://www.imore.com/2011/02/16/apples-subscription-service-good-bad-ugly/">relied on demographics</a> and marketing against them as a key revenue source. Another problem has been getting users to pay for content that they've gotten used to getting free on the web -- especially when publishers have asked fairly high prices (sometimes <a href="http://www.imore.com/2011/03/17/york-times-launches-digital-subscriptions/">higher than print</a>!)</p>

<p>So with more and more heavy hitters hitting the platform, but with everyone still struggling to figure out the business model, what does the future hold for iPad subscriptions? Do we need an iMags/iNews store like iBooks? Or is it just the wrong medium for an outdated message?</p>

<p>Time Warner Cable has had to remove channels from its iPad application, TWCable TV with immediate effect. We <a href="http://www.imore.com/2011/03/24/time-warner-cable-receiving-cease-desist-orders-ipad-app/">already heard that this</a> may be happening but Time Warner has now confirmed this with a company statement. The networks that seem to have taken umbrage with Time Warner are Discovery Communications, Fox Cable and Viacom. This means the next time you fire up your TWCable TV application on your iPad, you will be missing Animal Planet, Discovery, TLC, FX, National Geographic, BET, CMT, Comedy, MTV, Nickelodeon, Spike and VH1.</p>

<blockquote>Unfortunately, the owners of those channels don't yet share our vision for making it easy for consumers to view the content they've already paid for on different screens within the home. We would rather use our technical resources to distribute the channels of programmers who agree that their content should be seen on any screen inside your home, while we pursue legal solutions that would let us continue deploying this Application.</blockquote>

<p>Just as <a href="http://www.imore.com/2011/03/29/amazon-cloud-music-launched-licenses-record-labels-fuming/">Amazon is facing resistance</a> in letting customers stream their own music, this once again shows the wide gap between new technology and old media. Time Warner is clearly very unhappy about the situation and have set up a dedicated site to provide up to date information on any future developments.</p>

<p>The iPad has seen amazing success since its debut, even <a href="http://www.imore.com/2010/10/22/ipad-6month-table/">surprising us</a> in some cases.  With the holiday season upon us, it will be interesting to see the sales numbers Apple has to announce on their next earnings call.</p>

<p>PEOPLE magazine is now available for iPad. The application is free to download, but each issue is a $3.99 in-app purchase. However, if you are a subscriber to the print version of PEOPLE, you get the iPad version for free! Unfortunately, there is not a subscription model in place with the app. So subscribing to strictly the iPad version is not an option. </p>

<p>In addition to the content of the print version of PEOPLE, the iPad version offers even more:</p>

<ul>
<li>Double the number of Star Tracks pics, plus bonus, iPad-only, photo galleries throughout the issue</li>
<li>Special celebrity videos </li>
<li>Movie trailers, TV previews, song samples and other entertainment extras </li>
<li>Instant breaking news updates on our top stories throughout the entire week</li>
</ul>

<p>It's great to see big media making a step in the right direction concerning digital distribution. I initially found it odd that PEOPLE magazine did not implement an in-app subscription model, but this decision was likely made because Apple gets a 30% cut from subscriptions. If I'm interested in a digital subscription to PEOPLE magazine, I can subscribe to the print version and get the iPad one for no extra charge. Meanwhile, PEOPLE is getting 100% of my sign-up fee instead of only 70%. </p>

<p>Is this a smart choice, though? PEOPLE would cut the cost of making and shipping prints if they had an iPad-only subscription available to customers. But would these savings balance out the 30% cut to Apple? Also, it's much less convenient for me to sign up for the print version than just a quick tap for the iPad version. I likely may never actually sign up for the magazine even if I intended to. So PEOPLE magazine just lost me as a customer. How many potential customers are being lost by not having an iPad subscription available? These are all things that PEOPLE magazine and Time Inc need to take into serious consideration. </p>

<p>One exciting thing about PEOPLE magazine's iPad release is that it's a good sign that other Time Inc magazines will be hitting the app store soon. It is expected to see the rest of their apps in the next 30 days. </p>

<p>Any PEOPLE subscribers taking advantage of their free digital copy? I purchased the most recent issue and find the app to be very well made. Does availability on the iPad entice anyone to purchase a print subscription? Are you subscriber to a different Time Inc magazine and eagerly waiting the release of an iPad app? Lastly, what are your thoughts on their current business model? Are they making a good choice, or do they need to provided an in-app subscription to customers?</p>

<p><em>MediaMemo</em> is saying Time Inc. is having trouble setting up their own subscription service for a Sports Illustrated iPad magazine app:</p>

  <p>Last month, the publisher was set to launch a subscription version of its Sports Illustrated iPad app, where consumers would download the magazines via Apple’s iTunes, but would pay Time Inc. directly. But Apple rejected the app at the last minute, forcing the Time Warner (TWX) unit to sell single copies, using iTunes as a middleman, multiple sources tell me.</p>
</blockquote>

<p>First, at the iPhone 3.0 event in 2009, Apple showed off App Store subscriptions for magazines alongside in-app purchase, but while in-app purchases are now fairly common, I'm hard pressed to find a showcase example for App Store subscriptions. What happened to them? Are publishers not eager to embrace them or has Apple not provided the mechanism?</p>

<p>Second, it looks like Time is trying to go around the App Store for subscriptions, kind of like what Amazon and Audible do for users who buy books via Mobile Safari on the web but can then download their library in-app. Is Time trying to do something similar to that but not getting their app approved?</p>

  <p>So what happened? The Time Inc. insiders I talked to don’t have a clear answer, presumably because they can’t get one from Apple itself. One theory: Apple is concerned about the publisher’s plans for the consumer data it would collect with each subscription. A darker one: Steve Jobs loves the idea of digital magazines and wants to control the market for himself.</p>
</blockquote>

<p>"Darker" certainly scores the melodramatic points, but Apple had no problem rolling out iBooks while still allowing the aforementioned Amazon Kindle app and a host of other competitors. They've let streaming music and video apps in to vie for music money against iTunes.</p>

<p>Due to the opaque nature of the App Store approval process, and Apple's secrecy surrounding unannounced features and technology, there's never an easy way to tell if a delay is political, business related, or because Steve Jobs will be announcing some new magazine-focused API for subscriptions in September.</p>

<p>These are huge companies, there's a lot of money on the table, and a critical amount of personal user data behind it. I'm sure we'll see a lot of foot stomping and fist shaking, and press leaks to spin the story. I'm sure we'll hear cries that evil Apple is denying big publishers their control, and big publishers are gouging users for digital copies. Fine. At the end of the day I want what I think most end users want -- an easy, secure, privacy-protecting way to get my magazines (and comics!) on my iPhone and iPad at a fair price. Apple wins. Publishers win. We win.</p>

<p><a href="http://www.time.com/time/specials/packages/article/0,28804,1945379_1944278_1944287,00.html">Time magazine</a> has made the Motorola Droid its number 1 gadget of the year while our beloved iPhone ranked in at number 4 behind the Barnes &amp; Noble Nook e-reader, and the Dyson Air Multiplier. What pushed the Droid to the top of the heap of these gadgets was the combination of its Motorola hardware and Android 2.0 software.</p>

<blockquote>
  <p>"A smartphone operating system isn't all that satisfying without an actual kick-ass smartphone wrapped around it. Now Android has one: The Droid is a hefty beast, a metal behemoth without the gloss and finish of the iPhone, but you don't miss it. The Droid's touchscreen is phenomenally sharp and vivid, it has an actual physical (not great, but good enough) keyboard, and best of all, the Droid is on Verizon's best-of-breed 3G network. It's Android's first credible challenge to the iPhone."</p>
</blockquote>

<p>The reason why the iPhone 3GS ranked in at number 4, well to put it simply, was the lack of new features.</p>

<p><blockquote>"Take the iPhone. Make it faster. There, you're done. Yes, the 3GS has a better camera — with video. And it has a compass and voice control. Those are all improvements over the original."</blockquote></p>

<p>So there you have it folks, in the past the <a href="http://www.imore.com/2009/07/03/iphone-3gs-1-smart-phone-ratings/">iPhone and awards</a> have gone hand and hand. As it stands now, the iPhone is no longer an award winner. Hopefully that all changes come this June/July.</p>
