<p>Composers, writers, and publishers of the music Apple sells in the iTunes stores are petitioning the government to mandate that Apple should not only pay them their cut of the sale price (which they already get) but should also fork over a performance fee for the 30 second samples iTunes provides to help sell that music.</p>

<p>Now, we&#8217;re all for content creators getting a fair cut of the profits &#8212; indeed we are content creators here at TiPb editorial &#8212; but, a) asking that marketing done to help sell your music be deemed performance that requires payment, and then b) when failing to negotiate that with Apple, asking the government to mandate it?</p>

<p>Imagine Nike demanding a shoe store pay them to display Nike shoes on the wall. Strangely, in the reality we live, typically you <em>pay</em> for advertising, you don&#8217;t get paid for having your product advertised (if so, we&#8217;re going to get some TiPb signs up in Times Square and have NYC pay us a bundle).</p>

<p>Getting back to the fair cut of profits &#8212; creators have historically gotten shafted and we get that. But they&#8217;ve historically gotten shafted not by Apple or other online, or even brick and mortar retailers, but by Big Media (in this case the record labels). If the creators want to go after them, want to rectify the bad deals and swindles of the past, we&#8217;ll get the popcorn and spicy drink and cheer them on.</p>

<p>They also want performance fees for downloads, which is equally stupefying, since buying a song electronically is not analogous to Apple performing it, but to buying the CD. If Apple were to hold a live streaming concert on Apple.com, then, yes, performance fee.</p>

<p>Okay, maybe we&#8217;re being too one side. Maybe Apple is an easier, trendier target, and if Big Music won&#8217;t pay artists what&#8217;s fair, maybe Apple should be forced to pay unfairly. And if they are, maybe Apple should turn around and charge the artists 110% marketing/brokerage fee for putting the samples up to encourage sales&#8230;</p>

<p>Now excuse us, we&#8217;re off to bill Amazon for the cover art and sample pages they&#8217;re using to sell our pulp novels&#8230;</p>

<p>The <a href="http://www.ft.com/cms/s/0/0b7b66fa-7a45-11de-b86f-00144feabdc0.html?nclick_check=1">Financial Times</a> is reporting that Apple may be in cahoots with the Big Music record labels, Sony, Warner, Universal, and EMI to create bonus-material laden Apps in an attempt to reignite interest in full album purchases among consumers. This project is said to be code named &#8220;cocktail&#8221; and would include:</p>

  <p>a new interactive booklet, sleeve notes and other interactive features with music downloads</p>

<p>Since the advent of iTunes, sales of digital singles has risen but full albums has fallen. In previous decades, from vinyl through cassette and compact disc (CD), with the exception of 45s (original, not the <a href="http://www.imore.com/2009/07/14/itunes-future-d45s-2-songs-1-price/">new digital kind</a>) and compilations, albums were often the only way to get popular tunes.</p>

<p>While some, including our own editor-in-chief, still prefer buying whole albums so as to get the whole &#8220;story&#8221; an artist is trying to tell, others have maintained since the days of vinyl that some artists were just as content to put effort into a couple hit songs then quickly produce filler for the rest of the album.</p>

<p>So &#8220;Cocktail&#8221; could well enhance even those mega-albums filled with great music, much as they did in the heydays of physical media, but will they be compelling enough to get consumers to fork over $9+ instead of $1.29 to get filler from that one hit wonder as well?</p>

<p>Apple has just released yet another new pricing model onto the iTunes Music Store: D45s [<a href="http://itunes.apple.com/WebObjects/MZStore.woa/wa/viewCustomPage?name=pageDigital45s">iTunes link</a>]&#8211; two songs for one lower price ($1.49 to $1.99).</p>

<p>Confession: I&#8217;m old enough to remember the original 45s, those lovable little vinyl (Google it!) records with a hit song on one side, and something ranging from awesome to ridiculous on the other.</p>

<p>Those days are gone, as are the days of $0.99 fixed pricing (though admittedly albums were alway a volume discounted exception), but Apple&#8217;s hoping the Digital 45s prove to be as popular as the record companies no doubt hope they&#8217;ll help move more music through the age old bundling scheme.</p>

<p>Apple Insider reports that D45s will be exclusive to iTunes only through July 27, at which point other digital music retailers will be able to offer them as well (which, until Amazon MP3 bothers to roll out internationally, means they&#8217;ll likely stay exclusive to iTunes in most countries outside the US and UK&#8230;)</p>

<p><a href="http://www.appleinsider.com/articles/08/12/08/rumor_apples_itunes_going_drm_free_starting_tuesday.html">Apple Insider</a> has published a rumor saying Apple&#8217;s iTunes service is about to match Amazon MP3 by going DRM free. This follows on a <a href="http://www.imore.com/2008/11/29/itunes-plusier-beatles-bailing/">previous story</a> saying Apple was in negotiations to do just that.</p>

<p>Since the introduction of iTunes Plus (the name given to the higher-quality 256 bit DRM-Free music), only EMI has allowed Apple to carry their music in that format, with Warner, Sony, and Universal refusing to do so, instead only offering them to iTunes competitors like Amazon, Napster, etc.</p>

<p>What&#8217;s changed? Maybe nothing. Or maybe iTunes has just kept growing stronger and is now in a position where they can negotiate the same, consumer friendly deal?</p>

<p>The rumor says we may see the change as soon as tomorrow, December 9th.</p>

<p>Universal Music Group, Warner Music Group, and Sony BMG currently provide DRM-free music to rival services like Amazon MP3 as a way to promote competition to iTunes, though the lack of availability of these services outside the US, along with iTunes continued (and growing) dominance in digital music, may be causing them to rethink that position.</p>

<p>EMI, of course, has been offering DRM-free music via Apple&#8217;s iTunes Plus service since it launched, and at double the bit rate (quality) of the regular music.</p>

<p>Hopefully we&#8217;ll soon see the day that big music decides to stop treating their customers as de facto thieves and realizes offering quality goods at fair market prizes is the only real way to stop piracy.  Or am I the crazy one?</p>
