iPhone vs. Pre: Fruitless Claims or... Analysis?

What's the one thing worse than bloggers offering opinions about the likelihood of an Apple vs. Palm patent fight? That's right! Analysts! (Where's our magic 8 ball for a dissenting view when we need it?!)
PreCentral.net picks up just such a story on how one analyst thinks Apple's IP claims against Palm just might be -- wait for it! -- fruitless:
Though the review of granted and filed patents shows that Apple has a "formidable arsenal of capacitive, multi-touch patents that constitute a nearly impenetrable barrier to entry for companies hoping to commercialize capacitive, multi-touch devices," Perez-Fernandez also noted that Apple’s key patents may be “invalidated based on prior art considerations if subjected to a review by the USPTO.”
Prior art can trump all, unless Apple's own early patents, or the ones it acquired from Fingerworks, are the most "prior" of relevant art in question.
Of course, Apple has $30 billion reasons more than Palm for just why it might press its case anyway, even if it's ultimately unsuccessful...

They stole the ui right down to the animation they have no shame. At least rim came up with the clickscreen. Android has the notification thing. Don't tell me that cards thing is innovative it's basically if safari stayed open all the time.
@Jeffdc5: Give them the credit for the implementation, am sure both (all) have lots "stolen" from others!
Come on be real here some people copy mobile standards like airplane mode contacts ect... But to steal the ui completly is shamefull every other company comes up with their own ui and innovation palm stole right down to the album art "let's just tilt them nobody will notice"
Jeff, Try looking up how many Palm/ other patents Apple has been using, sure they might not be as "appealing" as a fancy UI but they sure are some serious innovations in themselves. Am not an expert but can see that theres a lot of grey when it comes to who is doing what.
Stealing is not a good thing for sure, but it seems we do not seem to have a clear definition of stealing/ stolen when it comes to these things! Strange are the ways...
Listen Amon, palm totally stole nearly every implemetation of the iPhone's UI, look and feel, and even down to the root kernel based ss-u.I.d! Now I am an expert at these things and I'm saying my self that palm has retreived and stolen many of the unix based system iPhone offers. But the truth is inevitible- by the time all of these companys catch up to apple, they will have moved on.
@Blake: Even while assuming that Palm has copied the implementations from Apple I am bothered since from what I know the foundation OS is open source. The stealing part would anyways be sorted out by these guys through litigation and I would be keenly follow that!
I've posted here before, and to be clear, I like the iPhone. But as a Sprint customer I am looking forward to the Pre. I'm curious about the idea that Palm stole the UI. Wow. Icons to load applications. Application windows that move. I hardly think Apple came up with those ideas. Showing album art - that's been around since before iTunes.
As Appple fans, you aren't going to switch to the Pre, and there are an awful lot of people who won't or CAN't switch to AT&T. What is wrong with these people being able to have a sophisticated and attractive 3G phone? You don't have to like it, but it seems somewhat childish to put the Pre down as much as many of you seem to be doing.
I'm not asking to be flamed, but I'm prepared for it.
